Q&A with SHRS: Understanding Pay Transparency & Wage Compliance

Are businesses in North Carolina required to disclose salary ranges in job postings?

No. While businesses are under increasing pressure to disclose salary ranges in job postings and ensure fair pay practices, North Carolina does not have a statewide law requiring pay transparency. However, North Carolina does have other laws that protect employees' wages.

How does pay transparency impact hiring and retention?

He also finds joy in service. Through his church, Kelly and Gina participate in disaster relief missions across the state, most recently supporting communities in western North Carolina following Hurricane Helene. Kelly has also served on the Board—and as Board Chair—of the Cumberland Community Foundation, deepening his impact within the broader Fayetteville community.

Can employers prohibit employees from discussing their own pay?

No. The National Labor Relations Act (NLRA) prohibits employers from restricting employees from discussing their wages or benefits with coworkers. Employers also cannot interrogate, threaten, or surveil employees over wage discussions. Violating these protections can result in legal consequences and reputational damage.

Why should small business owners regularly review their compensation rates and structures?

Small business owners should regularly review employee compensation, update job descriptions, and clearly communicate pay policies. Staying informed about evolving wage laws and embracing transparency can help businesses remain compliant, build trust with employees, and attract top talent.

What steps should small business owners take to stay compliant with wage laws?

Regularly reviewing compensation structures helps ensure fair and competitive pay, reduces the risk of pay disparities, and keeps businesses aligned with evolving wage laws. A proactive approach can also improve employee retention and job satisfaction.

"Being a small business owner is very difficult. There are so many things that we don’t know or think about. Debbie helped me with my practice in so many ways. She is very knowledgeable, experienced, and easy to talk to regarding HR services. She assisted me with the hiring process and the firing process. I had never fired an employee, and she coached me through every step of the process. She also helped put certain processes in place for me going forward. I am very grateful to have Debbie and Strategic HR Solutions, LLC on my side. This is one area that I don’t need to worry about anymore."
